Notice of Motion

Notice of Motion must be served o the defendant 16 court days prior to the hearing date. Occasionally, a Judge may order a shorter time (Order Shortening Time) for service. Service may be made pursuant to CCP 1010, et seq., by deliver to the receptionist or anyone in the law firm between 9:00 AM and 5:00 PM. Service may be made on an In Pro Per (Party without an attorney, self represented) party by delivery to anyone at the party's residence between 8:00 AM and 6:00PM. Otherwise, service on a party must be made personally. Service may be made by mail and the noticing requirement is extended by 5 days (21 days total). (CCP 1005, CCP 1011, CCP 1013)
